    Please, someone out there inform me of the following situation. My Costa Rican husband and I have a 7 month old child and we’re living in Canada. My husband has a daughter in Costa Rica and has been sending his ex-wife $300- 500 US monthly ever since he touched Canadian soil 4 years ago. She says it’s never enough and that there isn’t enough food to eat (I know she’s lying). Her argument is the child should not have to “pagar los platos rotos” of the relationship and that she will put a “penion” where he is going to have to pay $900.00 monthly because of her and her daughter’s “estilo de vida” they were accustomed to when they were together. His ex wife is a high school teacher (teaching for 10 years now) and he was a waiter/store manager at the time, getting paid cash in the amount of 800 US. My question is, is $300 US monthly enough? How much does a high school teacher make teaching for ten years? Does his ex wife have the right to get $900 monthly for child support. She is doing quite well for herself on her own. She has a nanny, cell phone, 2004 car (she purchased 2 years ago), house (with six years mortgage left)and likes to drink the most expensive whiskey. Did I mention she lives in a small town in Puntarenas? Please HELP!!!!!

    Well rest a sure that he won’t be paying 900.00 a month from his life style in CR.

    My brother in-laws which have a track record with women and child support and could make a soccer team with their kids could tell you some stories. Costa Rica is getting much tougher with the laws regarding child support how ever my brother in-laws make a heck of a lot more money than a waiter and a school teacher and pay a heck of a lot less than 900. a month.
    What your husband should do is find a good lawyer in CR that will help with this situation.
    How ever all of the stuff that she has or does dosent matter that I understand from my in-laws.
    How ever what does matter is that he has to have a written order regarding payments. When ever my brothers leave the country they have to make sure all child support is pay for one year in advance before they can leave. They did have payments in written orders with the country.

    thanks for your reply scottbenson. How does child support work in CR then and how is the monthly support calculated? His ex is determined to get that money b/c when my husband touches CR soil the first place he’ll end up is in jail.

    As you will see from our ‘Costa Rica Salaries’ article from June 2006 at few people make that kind of money in Costa Rica.

    According to La Nacion dated 12th September 2005 “El salario base de los docentes del sector público es de ¢127.000 al mes. Sin embargo, los incentivos permiten a estos servidores alcanzar un ingreso promedio mensual de ¢425.000 (334% más).”

    Meaning the base salary of teachers in the public sector is c127,000 per month (US$243) but with the permissable incentives a hard working teacher can earn as much as c425,000 per month – At c522:US$1 that is $814 per month.

    I would have thought she should have been thrilled to receive $300-$500 per month but perhaps she has her eyse on the newe Mercedes.

    You are right Scott she should be thrilled,

    One of my brother in law is only paying 100.00 for two kids. How ever he has hid his income because the company is in his name and my other brother-law. How ever the Cr goverment is cracking down and one time they came to the biz looking for him because he didn’t pay for 3 months. Even though he has the money when he is upset with the ex he will stop paying, this kind of mentality is coming to a stop.

    If I was her I would contact the embassy and a lawyer in CR that their family trusts. Then he would have to go back and fight it out in the courts. Since the CR goverment does have the right to extradite the father from the U.S. (I don’t know about Canada)he needs to take it seriously and get a hold of the CR embassy today!

    CR is cracking down and they are getting a heavy hand on child support.

    I would like to thank you as well Mr. Oliver for taking the time to provide me with so much information. Although I showed my husband this, he still insists that the cost of living in CR is high and that’s why he sends so much. I want him to stop b/c i believed he was sending too much. He is also sending 100US to his mother. Now that he has had the nerve to tell his ex that he might not be sending so much, she threatened to put a ‘pension’ on him. I just want what is fair so that we can all live comfortably.

    Now Carli, don’t get me wrong.

    If you husband feels that he needs to send more money that is different. My wife was telling me that the Costa Rican goverment will go by what the father makes in Canada. So if you are in Canada and make more money than in Costa Rica you will be subject to the percentage of that amount. Not what is the cost of living in Costa Rica!

    What my brother in-laws did was to negotiate the amount of money to be paid with their ex wifes or ex lovers. This was easyer than working it through the goverment which they would have had to pay more money.

    Again the best thing to do is get a hold of a good family lawyer in CR and start working with the embassy in Canada. You don’t want to get in trouble with the child support issues because CR will and do enforce them. A couple of years ago they changed many laws and regarding family laws, so they will reach out to other goverments for help. In fact if a family members mother is in dire need of support the family can be taken to court to support the mothers need from the goverment.

    One of my wifes cousins that lives in Florida was not taking care of their mother. He was not sending money and the mother stayed at a cousins home. She had problems with alshimers, the courts in Costa Rica demanded the U.S. goverment to garnish wages and they did.

    So the question is what is fair? In this case what ever your husband and the ex wife can agree on. Like my brother in-laws had to do they had to kiss some culo.

    I also live in Canada and own property in Costa Rica.

    Sorry but $900.00 a month seems like a lot. We live down there for a month every year with a family of 5 for about $1000.00 a month and that is eating most meals out.
