I will make this short.
Last July of 2007 I sent them a deposit to hold a lot for us. We went in Oct. to view the lot but, there was no access to view it.
We wasted our time and money and asked for our refundable deposit back. They first said they would return it ASAP!, then they said it would take 60 – 90 days, then they said they would first have to sell the lot to someone else.
It is now April of 2008 and we are still waiting. We have hired a lawyer in CR.

Just so I understand this correctly:
You paid a deposit to buy land from Costa Vista Land but when you visited, you could not actually get access to visit the land that you are in the process of buying?
Did you agree to buy the property without seeing it? Did they show you photographs?
Did you check the folio real (the property registration number which shows title etc) before agreeing to buy this land?

Our decision was to be made after viewing the lot. We did not see any photos, we only had a plat map, I was given a folio real # but it was not for this property.

They were very underhanded and extremely unprofessional.
I was looking at making a 15 acre purchase from them and they would not let me perform adequate due diligence via my legal counsel before wiring them $50,000 even though we produced for them our paid travel itinerary for two days later and could bring a check with us. A respectable firm would not put such undue pressure on their customers. Ends up they didn’t even own the land…they had a “JV agreement” with the land owner, however they would not send me the signature page to prove its execution. My attorney advised me to not work with this group.
This group is short on cash and have likely already spent your deposit on development costs, hence why they need to sell your lot before they can refund your deposit.
I feel for you! What project were you buying into? Scott’s advice is 100% true and very valuable.
April 23, 2008 at 9:43 pm #190417apexitMemberAnother problem you are going to run in to is finding a lawyer. Most Lawyers are civil attorneys. Want to avoid lawyers all together put in your contractn that any dispute will be settled by an arbitrator. The process is quick and fair. Civil lawyers will want you to just settle because they will tell you the courts are so backed up. You need to hire a criminal attorney. The CR prosecutors are very aggressive when it comes to taking your money in CR and not returning it is a violation of the penal code. Wnat the name of an inexpensive criminal lawyer? Let me know when you get tired of no results

You are right. I have been wasting my time with a civil lawyer that I was using for other purposes. You mentioned that you had a name of a criminal attorney. If you could, please forward his information. Thank you.
