As extracted from the Costa Rica Penal Code as associated with the national constitution per defamation of character, which in Costa Rica, is a criminal offense:
The Costa Rica Penal Code outlines the law that identifies defamation, libel, slander, and calumny as offenses against a person that can carry criminal penalties, which have and can include prison time and fines for those convicted. The Penal Code punishes anyone who produces and/or reproduces statements declared defamatory to others, including anyone proven to be associated with this crime.
The Penal Code contains the laws that deal with crimes in the form of libel, slander and defamation. Defamation, which includes libel and slander, occurs when a false or malicious statement harms the reputation of another person by lowering his standing in his community or place of business. Libel is expressed by print, writing, pictures or signs. Slander is expressed by oral expressions or transitory gestures.
CRIMINAL LIBEL, AND DEFAMATION: SLANDER AND LIBEL
Costa Rica Criminal law is governed by the federal criminal code, which contains the offense of defamatory libel and blasphemous libel. Defamatory libel is matter published, without lawful justification or excuse, that is likely to injure the reputation of any person by exposing him to hatred, contempt or ridicule, or that is designed to insult the person of or concerning whom it is published.
Everyone who publishes and/or contributes to a defamatory libel that he knows is false, even in part, is guilty of an indictable offense and liable to possible imprisonment, with accompanying fines.
The proprietor of a newspaper is liable for the libel unless he proves that the defamatory matter was published without his knowledge and without negligence on his part.

I thought the Government of Costa Rica held the monopoly on issuing insurance. The title insurance seems rather worthless, in this case. I have actualy been to both locations, and there is no development as shown in Leu’s ads. Perhaps this attorney has some photos of this land he can show us?

They have granted a monopoly to issue insurance to INS which is a privately held company. That monopoly will surely disappear with the development of the economy under CAFTA.
August 10, 2009 at 9:50 pm #197204jt_60601MemberPer the Costa Rica civil code for real estate, properties being subdivided from a larger property can be sold based on the square meters of land to be divided off.
The land was never stated nor advertised as a development with utilities, but as raw, virgin land with potential land value appreciation as the area develops.
As all real estate transactions are legally driven by the terms offered, and accepted, the terms stated clearly before purchasing, that the initial document received by buyers, was not the final document, as upon building, or could be done anytime, the buyer in accepting the sales terms, agreed to follow the legal process listed to have a power of attorney processed for seller’s corporation, which is taken by the seller to sign in front of a Costa Rica, US consulate, then back to buyer to gain survey, where the Costa Rica documents are generated. This was stated clearly up front in the sales terms for all buyers. Mr. Leu has completed this process with the consulate a number of times, where the consulate, a govt official, has to check all for Mr. Leu’s clear ownership, which was done by the consulate on each visit.
Illegal claims on the land hindered this final survey process for some buyers, with realtor M. Pinto being one of these illegal claims, now filed in court, with additional defamation of character lawsuit also filed per M. Pinto’s legal slander and libel.
The National Registry lists at any time looked up, Mr. Leu’s clear ownership, being accepted by the National Registry as clear and exclusive ownership. Below are the directions for looking up, clearly showing Mr. Leu’s Costa Rica corporation ownership, and again below a title company in San Jose, Stewart Title, their title search before he sent any money to the original attorney in Costa Rica in 2002. Mr. Leu himself can do nothing for the ownership to show as directed: all was done thru a Costa Rica attorney, and surveyor hired, where the National Registry itself, being part of the Dept. of Justice and thus the federal govt., has to check all before can list as directed below. Pinto’s news article and web site that clearly violate Mr. Leu’s civil rights. Those showing association to this defamation of character are also being legally confronted in a similar legal fashion. By Mr. Pinto stating Mr. Leu’s title is fraudulent, he is stating the National Registry is fraudulent as Mr. Leu’s title is clearly demonstrated by the National Registry officials, as such being turned over to the Dept. of Justice that houses the National Registry for its consideration of M. Pinto’s statements against them.

WeLoveCostaRica.comAugust 13, 2009 at 3:47 am #197206saltwaterMemberThe maps you provided to your vitims/”customers” clearly show the individual lots. Both the Jaco and Margarita maps. Both maps also show roads. However, there are no dimension provided for ANY of the lots, they are all listed as “1.75 acre lots with ocean views”. None of these properties have oceanviews. The fact that these units are being sold as “lots” would indicated that there has been some type of survey and staking of the area to define the perimeters of the “lots”. So for example, if you bought lot 56, you should be able to find it, correct? You should also be able to provide the dimensions of the lot, also, correct? There are no measurments on any of the maps provided, and when you ask for the dimensions of your lot, that you purchased, by its number, you get no response, or you are threatend with a lawsuit.

there is NO LAWSUIT against us..because defamation, slander and libel are only illegal IF the facts being spread are wrong. In this case, they are researched and accurate…with many victims. OUR CLAIMS are ACCURATE. This must explain why I have not been served ANY papers or notification of any lawsuit by Mr Leu or his representatives….
FOUR victims walked into my office this week….
It should be noted that Mr Leu has been reimbursing the victims…if you begin to take legal action
October 27, 2009 at 1:48 pm #197209saltwaterMemberLeu reimbursed myself and 3 other victims that I know of once we called him out on it. I believe the best way to put this thing to rest is to let the IRS have a good look at his “business”. There are probably hundreds of victims out there who are blissfully unaware they have been scammed. The numbering on his maps started out with 1-140, and now it is in the 600s, so that in itself is a glaring example these “lots” that he does not own hae been sold multiple times each, which is another crime in itself.
