When choosing a Costa Rican Attorney, it would be important to make an inquiry as to his/her current status and disciplinary history with the College of Lawyers (Colegio de Abogados), the equivalent of the Bar Association, or the Law Society, in a U.S., or Canadian jurisdiction.

This is actually a relatively simple procedure, which requires a quick visit to the Colegio de Abogados de Costa Rica website here.

On that web site, there are a number of boxes you can click on, you want to click once on the green box that says Consultas Sobre Agremiado.

On choosing this particular menu item, a choice will appear to either enter the first name (Nombre), the First Surname (Primer apellido) and Second Surname (Segundo apellido) or clicl on the menu at the top where it says Nombre – Número de Carné – Cédeula and you can search for an attorney using those search terms if you have that infortmation.

If for any reason this information does not appear, it is likely that they are not incorporated with the College of Lawyers and are not legally able to practice law in Costa Rica.

Another important inquiry which may be made about your Attorney on the same web site, is whether he/she has been suspended by the College of Lawyers for either a disciplinary matter, or administratively, for not paying the requisite dues to belong to the College of Lawyers.

Costa Rica’s Suspended Attorneys – Partial list as of 3 September 2015

You can see the complete list of all suspended attorneys (abogados (as) suspendidos) on the same website. By visiting the Profesionales Suspendidos Disciplinariamente page here, you can find the suspended attorneys and the duration of their suspension.

By entering your Attorney’s particulars (name, or incorporation number) you will be able to determine the disciplinary history of your Attorney, whether they have been suspended for failure to pay the requisite membership dues to the College of Lawyers, or whether they have left the practice of law on a voluntary basis.

Obviously, it is a more serious matter to consider if your Attorney has been suspended for a disciplinary matter, rather than merely for failure to pay his/her membership dues to the College of Lawyers.

Suspensions for disciplinary matters range from one month, for issues concerning matters such as administrative over-sights in record-keeping, to suspensions of ten to thirty years, for matters concerning involvement in a serious criminal activity, such as fraud.
