My job as your real estate agent is to protect you. That’s my number one job. It’s not to sell you a house. It’s to protect your investment. It’s my job to make sure that I find you a property that not only fits your budget but that doesn’t have any issues that come along with it.
So it’s also very important to make sure that we have good legal representation when you purchase that property. We have worked with many top-of-the-line law firms here in Costa Rica who can help you purchase the property and secure your investment.
The way we write an offer in Costa Rica is very similar to how we write an offer in the United States of America. The difference is it’s only three or four pages instead of 20 or 30 pages. It’s more like a term sheet in the United States of America.
What we do is we write a simple offer saying, “I will give you X amount of dollars for this property,” and we list the terms and conditions in that offer. The seller will then counter back and we will come to an agreement on the price.
Then we use a secure escrow company to handle all the money. We use a third party escrow company. That escrow company will take and hold the deposit until closing.
We also write the offer giving you 14 to 21 days for all the due diligence to be done on the property. So in other words, your deposit is fully refundable while the due diligence is being done.
This allows the attorney to make sure that there are absolutely no problems in any way, shape or form with the property. It also allows us to look at any other issues or questions that you might have. Maybe you need to know about buying furniture.
This gives us some time to get a quote for furniture. We want to get an inspection done on the house or have the property surveyed. This gives us plenty of time to make sure 100 percent that the property is free and clear and everything that you need to know is handled.
At the end of that 21-day due diligence period, the deposit becomes non-refundable and is held in escrow until closing. Most closings are anywhere from 30 to 60 days.
Four or five days prior to the closing, the title company will send you an email asking for you to send the balance of the money. Then at closing, the attorney will close the property for you and you will become the new owner of a little piece of paradise and the title company will make sure that everybody properly gets paid at closing.
I want to get paid for my work so they will make sure they pay me. They will make sure the attorney got paid for his legal work, that the government of Costa Rica got their transfer taxes and that the seller got their money.
