Boy, this forum is full of info! I think I’ve been stuck in another online forum for too long and haven’t looked around but am happy I did!
As many others, I’m considering retirement to CR, hopefully next year. I have an adult son with autism who receives disability which, I am told by SSA, will continue should we move to CR. It is not $1000/month, though. Does anyone know if he can be considered under my guaranteed pension? He’s been with me way longer than my ex!
Thank you!
Alley
I believe he would be covered, but advise you to get in touch with a lawyer to determine, the true facts.
I think he would have to be considered your dependant. If you have some court or legal papers proving this, you could use those when you apply for residency. Otherwise, he would have to qualify under his own steam which would not be possible since a pension of $1000 per month is now required.
Under the conditions you describe, your son qualifies to apply for residency as your dependent. As long as you can prove, via his primary care doctor’s letter, that your son has a handicap (in español, discapacidad) his age doesn’t matter and his income doesn’t matter because he doesn’t need to prove any income, as he would be applying as your dependent.
For more info see Articles 81 and 82 of the Ley de Migracion, the May 17, 2012 Reglamento or simply contact me off line.

I appreciate everyone’s responses so much! I’m delighted he will be able to come as my dependent. He has been disabled since birth and receives disability as adult child. He will qualify for my social security benefits when I die, which will put him well over the $1000 requirement. This is our hope for his independence as he cannot afford this in the US.
Again thank you!

That sounds like a great situation for both you and him. I am glad that he will qualify for residency as your dependent. So then the proof that he is your dependent will come from Social Security and that is what you will need.
